New York City Council     Members

This bill would require that the Department of Cultural Affairs (DCLA) provide reasonable advance notification of its intention to include works of art in a Percent for Art project on the Department’s website. The bill would also require that DCLA hold at least one public hearing on such works of art prior to inclusion. The bill would further require that notice of the hearing be published in the City Record at least fourteen days before the hearing will take place.

A Local Law to amend the New York city charter, in relation to the community engagement process in the percent for art law.
 
 
Be it enacted by the Council as follows:
 
      Section 1.  Subdivision d of section 224 of chapter 9 of the New York city charter is amended to read as follows:
      d. Reasonable advance notification of the intention to include works of art in a project shall be provided to the appropriate council member, borough president and chairperson of the community board of the community district in which the project is located. Reasonable advance notification of the intention to include works of art in a project shall also be posted on the website of the department of cultural affairs. Following notification of the intention to include works of art in any project, the department of cultural affairs shall hold or present at a public meeting, such as a meeting of the community board of the community district in which the project is located, on such works of art prior to such inclusion. A notice of such public meeting shall be posted on the website of the department of cultural affairs not less than fourteen days prior to any such meeting. All such works of art shall be subject to the approval of the art commission pursuant to section eight hundred fifty-four of this charter.
      §2. This local law shall take immediately after its enactment into law.
