New York City Council     Members

This bill would require the Department of City Planning to review and study the criteria and process for citing city facilities (often called “Fair Share”) and to report to the Mayor and City Planning Commission every five years on possible revisions and improvements to the Fair Share process.

A Local Law to amend the New York city charter, in relation to requiring a study of the city’s fair share criteria every five years

 

Be it enacted by the Council as follows:

 

Section 1. Section 203 of the New York city charter, as added by vote of the electors on November 7, 1989, is amended by adding a new subdivision d as follows:

d. The department of city planning shall study and evaluate the content and effectiveness of, and compliance with, the rules promulgated pursuant to this section. No later than twelve months after the local law that adopted this subdivision takes effect, and December 31 of every fifth year thereafter, the department of city planning shall issue a report to the mayor and the city planning commission on such evaluation, with proposed changes to such rules.

§ 2. This local law takes effect immediately after it becomes law.
